Unpaid stand downs

We have less children attending our service, can some staff be put on unpaid stand down?

Employees should only be placed onto unpaid stand down if the employer can meet the criteria in Section 524 of the Fair Work Act 2009. Employers cannot generally stand down employees simply because of a deterioration of business conditions, such as less children attending the service, or because an employee has COVID-19.

We encourage you to contact the Member Infoline on 1800 991 602 or (02) 4782 1470 to discuss other suitable options for managing staffing during the COVID-19 crisis.
