How do I pay Public Holidays during the Christmas closure period?

When calculating annual leave for employees employed under the Children’s Services Award, Clerks- Private Sector Award and the Educational Services (Teachers) Award (for services operating at least 48 weeks of the year) during the Christmas closure period, you need to consider public holidays. If a public holiday falls on a day that one of these employees normally work, the employee should be paid for this day at their ordinary rate. It does not come off their annual leave balance, nor does the employee get paid twice for the day.

For employees employed under the Educational Services (Teachers) Award working in services operating less than 48 weeks of the year (preschools) the employee is paid their normal salary throughout, which includes public holidays, or under certain circumstances the formula to calculate pro rata salary inclusive of annual leave is used to determine payment due during the Christmas closure which also includes public holidays.
