Do I have to pay the higher rate when a staff member attains a qualification?

If the service has required a person to be working towards their qualification and counted towards ratios, then yes, it is expected that the service will pay the person at a rate commensurate to the qualification once it is received. However, if a person is working towards a qualification independently of the service and the service has no requirement for that person to have the additional qualification, a higher rate of pay is not applicable. Of course, should the person’s role change and the higher qualification be required, the person should be paid in accordance with their qualification.
