Can I require an employee to take long service leave?

An employer may direct an employee to take long service leave. At least one month’s notice must be given by the employer if the employee is required to take long service leave when the leave falls due.

With the agreement of both the employer and the employee leave maybe postponed to an agreed date, however the employer can request the employee “freeze” the rate at which the postponed leave is paid. Please call the Member Infoline for more information.

An employer should have specific policies and procedures in place about how an employee should apply to take long service leave and what notice the service requires an employee to give.
